INDEPENDENT CONTRACTOR AGREEMENT / RELEASE OF LIABILITY
I, the undersigned, hereby represent that I am being engaged as an Independent Contractor
by The Promotion Company, Inc., upon the terms and conditions agreed upon between The
Promotion Company, Inc and me.
I also understand that, as an “Independent Contractor” I am not an employee of The
Promotion Company, Inc. The Independent Contractor shall not be considered as having an
employee status or as being entitled to participate in any plans, arrangements, or
distributions by The Promotion Company, Inc. pertaining to or in connection with any
insurance, pension, stock, bonus, profit-sharing, severance packages and/or unemployment
benefits or similar benefits for their regular employees.
The Independent Contractor assumes all responsibility for holding federal tax, state tax,
social security, public and private liability and workmen’s compensation insurance. Further,
no workman’s compensation, medical and hospitalization coverage or unemployment
insurance coverage will be provided to me by The Promotion Company, Inc. nor do its clients
assume any liability for injuries sustained by an Independent Contractor. For myself, my
respective heirs, legal representatives and assigns, I do hereby forever release, remise,
discharge and acquit The Promotion Company, Inc. and their respective successors and
assigns and agencies form any and all claims, demands, damages, rights, actions, causes of
actions, suites, debts, contracts, obligations, liabilities and all other claims and against all
costs of expenses, including reasonable attorney’s fees, arising out of or relation to my
engagement as an Independent Contractor by The Promotion Company, Inc.
